OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN, NOR WILL MAKING A PURCHASE INCREASE YOUR CHANCES OF WINNING.
CONTEST DATES/OVERVIEW: This is a skill-based jingle-writing contest (the “Contest”), which begins at 12:01 AM Eastern Time (ET) on November 6, 2007 and ends at 11:59 PM (ET) on December 1, 2007 (the “Entry Period”). The object of the contest is to have participants (the “Entrant” or “Contestant”) write a second verse for the existing Tastykake® advertising jingle; “Nobody Bakes a Cake as Tasty as a Tastykake” (the “Tastykake Jingle”) Entries submitted in accordance with these Official Rules will be judged on the criteria outlined in the “To Participate” section below, and prizes will be awarded to those entrants with the highest scores.
ELIGIBILITY: The Contest is open to students in grades one through twelve at the time of entry who are legal residents of the 50 United States or D.C. Employees and directors of Tasty Baking Company, and its subsidiaries, affiliates, independent sales distributors, retail dealers, advertising and promotional agencies (and immediate family members or those living in the same household with such individuals), are not eligible to participate. All federal, state, and local laws and regulations apply.
TO PARTICIPATE: There are 2 ways to enter:
(1.) Online (parental permission required for anyone under the age of 13). By no later than 12/01/07, visit the Tastykake website at http://www.tastykake.com, and follow the online prompts. You will be asked to enter a nickname for yourself, your age, your parent/guardian’s email address, the name of your school principal, music teacher, the name of your school, and your entry of a second verse for the Tastykake Jingle.
(2.) By mail. You may mail your entry by sending a hand-printed 3” x 5” card, including your full name, age, parent/legal guardian’s name, home address, day or evening phone number, the name of your school, the name of your school’s principal, music teacher and your jingle entry, to: Tastykake “Search for the 2nd Verse” Jingle Contest, 3413 Fox Street, Philadelphia, PA 19129. All information requested must be provided, and all entries must be received by 11:59:59 PM ET on December 1, 2007.
Entries will be judged on the following criteria;
A). Creativity/Originality: 60%
B). Link to Tastykake Heritage or Future Plans: 20%
C). Word usage/Grammar: 20%
JUDGING/VOTING: From all eligible entries received, one (1) Grand Prize Winner, one (1) First Prize Winner, and one (1) Second Prize Winner will be selected, on or about December 2, 2007, by a panel of judges selected by the Sponsor, employing the aforementioned criteria and under the supervision of the Sponsor.
TERMS/CONDITIONS: All entries become the sole property of the Sponsor and will not be acknowledged or returned. Entries must be in English. Each submitted entry must be the Contestant’s original creation, not previously published, and executed solely by the Contestant, who may not have won any other award using this jingle. The modification, enhancement or altering of a third party’s preexisting work will disqualify an entry as such entry will not qualify as an original creation. All entries must be in keeping with Sponsor’s favorable public image and reputation, and may be humorous, but may not disparage or diminish the name, reputation, goodwill or brand integrity of Sponsor and/or its products, and may not be lewd, unethical, offensive, scandalous, pornographic, defamatory or distasteful, as determined by the contest judges in their sole and absolute discretion. Entries may not defame or invade the publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights, including but not limited to intellectual property rights and the right to submit or use the entry. Submitted entries not complying in any way with the aforementioned criteria are subject to disqualification. No correspondence regarding entries will be entered into with the Contestants, except as provided herein.
Grand Prize: The School of the one (1) Grand Prize winner will receive $2,500 for use by its music department. The $2,500 prize will NOT be paid to the winner or the winner’s teacher personally. The principal or other authorized representative of the school must accept the prize on the school’s behalf, and sign any required documentation, including but not limited to a liability release and a publicity release (where permitted by law). The school will also receive a Tastykake Pizza and Krimpet Party (limited to 200 people) hosted at the school by Tasty Baking Company and Kirbee the Krimpet.
The Grand Prize winner will receive 6 tickets to the Kimmel Center’s December 15, 2007 special matinee performance of the Holiday Pops!, at which Peter Nero and the Philly Pops® will play a new arrangement of the updated jingle, including the winning Grand Prize verse.
The School of the Grand Prize winner will receive 2 tickets (to be provided to and disseminated by the school principal) to the Kimmel Center’s December 15, 2007 special matinee performance of the Holiday Pops!, at which Peter Nero and the Philly Pops® will play a new arrangement of the updated jingle, including the winning Grand Prize verse.
The Grand Prize winner must agree to participate in a public relations event on behalf of Sponsor at a mutually agreed upon time and date during 2007 and shall use reasonable efforts to ensure that winner’s teacher named in the winning entry makes him/herself available to participate in the event.
First Prize: The School of the one (1) First Prize winner will receive $1,000 for use by its music department. The $1,000 prize will NOT be paid to the winner or the winner’s named teacher personally. The principal or other authorized representative of the school must accept the prize on the school’s behalf, and sign any required documentation, including but not limited to a liability release and a publicity release (where permitted by law).
The First Prize winner will receive 4 tickets to the Kimmel Center’s December 15, 2007 special matinee performance of the Holiday Pops!, at which Peter Nero and the Philly Pops® will play a new arrangement of the updated jingle, including the winning Grand Prize verse.
Second Prize: The school of the one (1) Second Prize winner will receive $500 for use by its music department.
The Second Prize winner will receive 4 tickets to the Kimmel Center’s December 15, 2007 special matinee performance of the Holiday Pops!, at which Peter Nero and the Philly Pops® will play a new arrangement of the updated jingle, including the winning Grand Prize verse.
Prizes are non-transferable, and no prize substitutions or cash redemptions will be allowed except at the Sponsor’s sole discretion, who may also substitute a prize (or portion thereof) of equal or greater value. Winners will be notified by phone, e-mail and/or overnight mail. All winners and, where applicable, their parents/legal guardians and the principal or authorized representative of the school named in winning entry will be required to complete and return an Affidavit of Eligibility, a Liability and Publication Release and a Publicity Release (where permitted by law) within seven (7) days of the date of notification, or prize may be forfeited and an alternate winner selected on the basis of the criteria set forth herein. All prizes will be awarded, on the winners’ behalf, to a parent or legal guardian who must sign all required documents, and with respect to any travel that may be involved, accompany winner on such travel. Taxes on prizes, if applicable, are the sole responsibility of the winners.
PRIZE CONDITIONS AND LIMITATIONS: Submission of an entry grants Sponsor the right to use, publish, adapt, assign, edit, dispose of, and/or modify such entry in any way, in commerce and in any and all media worldwide, without limitation or compensation to the entrant, and entrants’ parents or legal guardians may be required to sign a release to that effect. Submission of an entry further constitutes the entrant’s, parent’s or legal guardian’s consent to irrevocably assign and transfer to the Sponsor any and all rights, title and interest in and to the entry. Such rights, title and interest shall include, but are not limited to, all intellectual property and licensing rights. By accepting prizes, winners and winners’ parents/legal guardians, teachers and schools grant Sponsor the right to use teachers’, schools’ and winners’ names, likenesses and biographical information for advertising, publicity, promotional and other purposes in commerce and in any media worldwide without limitation or additional compensation, unless prohibited by law. Sponsor assumes no responsibility for the following: (i) electronic transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected or not received by Sponsor or its agents for any reason, (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for destruction of or unauthorized access to, or alteration of, entries, (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants’ or any person’s computer and/or its contents, or causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Contest; (iv) any entries submitted in a manner that is not expressly allowed under these rules; all such entries will be disqualified; or (v) any typographical or other errors in the printing of the offer, administration of the contest or in the announcement of the prizes and/or winners.
By entering, entrants and their parents/legal guardians agree: (a) to be bound by the Official Rules; (b) that the decisions of the official judges shall be final and binding on all matters relating to the contest; and (c) to release and “hold harmless” the Sponsor and its affiliates, subsidiaries, divisions, advertising and promotion agencies, and all of their respective employees, directors, officers, shareholders, agents, successors and assigns (collectively “Releasees”), from and against any and all liability for any injuries, losses or damages of any kind including, without limitation, liability for personal injury, property damage or loss, (including without limitation attorneys’ fees, court costs and expert witness fees) caused by or resulting from or in connection with the acceptance, possession, or use/misuse of a prize, or participation in the contest or in contest-related or prize-related activities (including but not limited to travel related thereto), or the downloading or accessing of entry material. All federal, state and local laws and regulations apply.
DISPUTES: Except where prohibited by law, all disputes concerning this promotion will be governed by and construed in accordance with the laws, rule and regulations of the Commonwealth of Pennsylvania without regard to its choice of laws or conflict of laws provisions.
WINNERS LIST REQUEST: Winners’ names and the names of their schools and the teachers receiving the school-related component of the prizes can be obtained by sending a self addressed, stamped envelope to: Tastykake “Search for the 2nd Verse” Winner Confirmation Request, PO Box 25497, Rochester, NY 14625. Request must be received by 01/31/08.
